Please read these terms and conditions carefully before you start to use our website, before booking any services with Bandhu Panda and before making any purchases. Use of the Bandhu Panda website shall be subject to these terms and conditions, as may be amended from time to time, which shall be incorporated into the registration and/or booking form for Bandhu Panda and shall apply to any classes or group activities booked online, by telephone or in person with Bandhu Panda and to any orders or purchases made from Bandhu Panda online or in person.  These Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

1.   USE OF WEBSITE

Information published on this website is provided for the use of its visitors and you are advised that, although care has been taken to ensure technical and factual accuracy, some errors may occur.

No guarantee is given as to the accuracy or completeness of information on these pages. Please be aware that Bandhu Panda may alter the information on its website from time to time. Bandhu Panda shall have no liability arising from the use by any party of the information on this web site.

Bandhu Panda does not warrant the information on this web site in any way and in particular no warranty is given that the web site or its contents or hypertext links are virus free or uncontaminated.

You are advised to make your own virus checks and to implement your own precautions in this respect. Bandhu Panda excludes all liability for contamination or damage caused by any virus or electronic transmission.

2.   CONSENT FORMS

All persons taking part in any class, workshop, course or group session, including any individuals or children within your care, are required to fill out a consent form before taking part in the first class. We require the listed information to complete an individual profile and ask important medical information about the state of health of all persons that wish to take part. The consent form can be completed online but must be signed and provided to Bandhu Panda in advance or handed to the teach when attending the first class.

By signing the consent form, you are signing that you have read and agree in full with these Terms & Conditions.

For any children, a consenting adult who is responsible and consenting for all children in their care must complete and sign the form before returning this to Bandhu Panda in advance of the first class commencing.

3.   FITNESS AND HEALTH

Children under the age of 16 may only attended classes, workshops or group sessions if they are accompanied by an adult. Where classes, workshops or group sessions are offered for children, they are done for the child’s education and enjoyment under the supervision of their carer. As the person responsible for any children under your supervision you are responsible for the children in your care.

It is the responsibility of the individual taking part in the class, workshop, course or group session to ensure that you, and any individuals or children you are bringing to the session and responsible for, are capable of undergoing a routine of exercises. You accept the risk of injury from performing exercises and are advised to consult your doctor prior to beginning any session. All participants in classes, workshops, courses or group sessions are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. Where you are organising a group session on behalf of others you must confirm the same to each person.

Bandhu Panda reserves the right to refuse access to any person seeking to take part in a class, workshop, course or group session, if in Bandhu Panda’s absolute discretion, it considers that the health of the individual concerned may be endangered by undertaking such activity.

When our classes are being held online via live video stream. Your wellbeing is important to us, and as you will be practicing without the physical presence of a teacher in the room, you should avoid pushing beyond your existing limits.  By participating in our live stream classes, you agree that you will accept all responsibility for any injury you may sustain.  Please avoid attending online sessions if you're in doubt as to you ability to carry out the instructions safely.

Any person with low/high blood pressure and/or cardiac irregularities should not attend any class, workshop, course or group session, until they have written permission from their doctor. If there is any doubt, the individual should consult with their doctor prior to booking or taking part. All individuals attending or taking part in a class, workshop, course or group session must notify Bandhu Panda in advance of any circumstances affecting their health which may be exacerbated through the participation in the activity.

Bandhu Panda accepts no responsibility for any person who does not follow the instructed class or has not disclosed medical conditions or recent injuries to the teacher. Please be aware that it is your responsibility to inform the instructor if you feel unwell or any discomfort. If you find that you are pregnant, inform Bandhu Panda and/or advise the teacher as soon as possible as some of our classes will not be suitable for you. If you choose not to tell us or the teacher about your pregnancy, Bandhu Panda will accept no responsibility for any injuries or issues that may occur as a result of doing a class.

The exercises described on this site or via a class, workshop, course or group session are not suitable for everyone and are not a substitute for medical expertise. If done improperly, exercise has some risk of injury. If you feel discomfort or pain, DO NOT continue. Bandhu Panda disclaim any liability or loss in connection with the exercises described via this website or the services provided.

4.   DRESS, SAFETY AND HYGIENE

Any person attending a class, workshop, course or group sessions is required to wear a form of dress appropriate to the practice of Yoga, which may include stretch pants or shorts and a T-shirt or sports top. Yoga can be practised in bare feet. However, if you have any contagious foot complaints, please make sure you are wearing socks at all times.

In the interests of safety and hygiene, with the exception of water (which should be in a plastic sealable container) no crockery, glass or food is permitted in the studio where a class, workshop, course or group session is taking place.

5.    BOOKINGS AND CANCELLATIONS

Bookings for all classes, workshops, courses or group sessions must be made in advance. All payments for bookings are due on the earlier of the day prior to the start date or 30 days from date of invoice and are non-refundable.

If you are ever unable to attend a class or booking please give us as much notice as possible.

You can change or cancel any open class bookings up to 24 hours before the start of the class for it to be rescheduled. If you cancel or seek to change your open class booking with less than 24 hours notice then you will incur the full charge and the class cannot be rescheduled.

You can change or cancel any one-to-one class booking up to 72 hours before the start of the class for it to be rescheduled. If you cancel or seek to change your open class booking with less than 72 hours notice then you will incur the full charge and the class cannot be rescheduled.

You can change or cancel any group bookings, workshops, courses (in whole or in part) or events up to 28 days before the start date for it to be rescheduled. If you request to make a change or cancel any group bookings, workshops, courses (in whole or in part) or events with less than 28 days notice then you will incur the full charge and the group booking, workshop, course or event may not be rescheduled.

If a class, workshop, course session or group booking is cancelled by Bandhu Panda for any reason, we will make all reasonable efforts to contact you via email or telephone to let you know and arrange for it to be rescheduled or for a credit note to be provided. Bandhu Panda will not be liable for any other incurred costs or damages arising from or related to such a cancelation.

If we have to cancel or delay any class, workshop, course (in whole or in part) or event due to an event of force majeure (including but not limited to war, riots, fire, flood, hurricane, typhoon, earthquake, lightning, explosion, strikes, lockouts, slowdowns, epidemic, illness, prolonged shortage of energy supplies or an act of state or governmental action prohibiting or impeding any party from performing its respective obligations) we will not be held liable or responsible in any way but will seek to reschedule where reasonably possible.

All requests to change or cancel a class must be made in writing by email to info@bandhupanda.co.uk

6.   PURCHASING AND RETURNS ON SHOP ITEMS

Subject to the below, if you change your mind on any orders, you can return your items within 14days from the day you received the goods and we can either replace the item or refund you in full for the item(s), not including postage, provided they are unused, in their packaging and in a saleable condition. All postage and handling charges associated with returning the goods to Bandhu Panda are your responsibility. Once we have received the returned and unused items with a valid receipt we will aim to credit the full refund within 7 working days.

Please note there are some products where orders cannot be cancelled or returned and refunds will not be given, these include underwear, earrings, body care items (including without limitation creams/lotions/oils/soaps/lip balms), made-to-order or personalised products. Yoga mats, neti pots, tongue scrapers and grip towels can only be returned if they are still in their original and unopened packaging. All sale items are final sales.

If your parcel arrives damaged please sign for the parcel as damaged and take clear photographs before you open it to inspect the content. If you find that the contents has been damaged or is missing, please inform us immediately and within 3 working days by email to info@bandhupanda.co.uk.

7.   INTELLECTUAL PROPERTY

All intellectual property (including without limitation copyright and trade marks whether registered or unregistered) in the materials and resources provided or made available by Bandhu Panda on this website, in classes or otherwise belongs to Bandhu Panda, or is used by Bandhu Panda under licence, and unless agree otherwise cannot be used by you or anyone else other than for your own personal use and you may not share with any third parties, resell or otherwise attempt to commercially benefit from any materials or resources without the prior written consent of Bandhu Panda.

The resources and materials provided through this website or otherwise by Bandhu Panda may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited other without the prior written consent of Bandhu Panda.

Where any live sessions are provided online or where agreed in advance for any classes delivered in person, they may be recorded and may be made available to you by Bandhu Panda. If you participate in such sessions, you authorise Bandhu Panda to use your image and voice in any such recordings (and to make use of such recordings in any way that Bandhu Panda thinks fit) without payment, other conditions or need for further consent.

8.   LIMITATION OF LIABILITY

References to liability in this clause include every kind of liability arising under or in connection with these terms and conditions including liability in contract, tort (including negligence), misrepresentation, restitution or otherwise.

Other than in respect of those legal responsibility that cannot be exclude in law (such as for death or personal injury caused by negligence), Bandhu Panda (including its teachers, employees, subcontractors, representatives or agents) total liability to the individual, client and/or customer shall be the amount of fees actually paid for the relevant class, workshop, course, group session or goods. Nothing in these terms and conditions shall limit the individual customers or clients liability or payment obligations. Unless otherwise prohibited by law, Bandhu Panda expressly and wholly excludes any liability for loss of profits, loss of sales or business, loss of agreements or contracts, loss of use or corruptioin of software, data or information, loss of or damage to goodwill and all indirect or consequential losses.

Where any class, workshop, course or group session is provided at a location, Bandhu Panda accepts no liability for loss or damage to any property of an individual(s) or participant(s) or for injury to the individual(s) as such location or premises except insofar as such loss, damage or injury is by law incapable of exclusion.

9.   GENERAL

Bandhu Panda makes no warranties or representations of any kind concerning the accuracy or suitability of the information contained on this web site for any purpose. All such information is provided "as is" and with specific disclaimer of any warranties of merchantability, fitness for purpose, title and/or non-infringement.

Bandhu Panda makes no warranties or representations of any kind that the services provided by this web site will be uninterrupted, error-free or that the web site or the server that hosts the web site are free from viruses or other forms of harmful computer code.

Links to other web sites are provided by Bandhu Panda in good faith and for information only and Bandhu Panda takes no responsibility for the content contained in them and disclaims any responsibility or liability for any material communicated by third parties through this web site.

A person or third party who is not a party to any agreement with Bandhu Panda that incorporates these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any of the terms set out herein.

Any failure by us to enforce or exercise any provision of these terms and conditions, or any related right, will not be a waiver of that provision or right.

We may provide you with notices, including those regarding changes by email, regular mail, postings on the website, or other reasonable means now known or developed in the future.
